Information We Collect:

We collect information in order to provide the Platform to our business associates. We may collect this information in the following ways:

  • Information you give us. We will collect your personal information when you register to use our platform or contact us for any reason in person, over the phone or by email. This personal information includes your name, email address, mailing address, tax identification number, credit card information, bank account information or telephone number.
  • Information we get from your use of our website. We may collect information about your visitors to our website. This information includes:
    • Cookies. We send cookies to your browser to help us determine which content on our website appeals the most to you and what content you may have viewed on past visits. Cookies can enable us to customize the content according to your preferences and to save your password for ease of access. Our cookies contain personal information when you provide it to us. We also allow third parties to use cookies on our website, and these companies’ use of cookies is subject to their own privacy policy. We do not control the collection or use of information by third parties.
    • Google Analytics. We use Google Analytics; a web analyzing service of Google, Inc. Google Analytics is based on cookies. The cookie-generated information about your use of this website is transmitted to and stored by Google’s servers in the US. Google will use this information on our behalf to evaluate your use of the website, compiling reports on website activities and further use of the website and Internet related services.     • Browser information. We collect information sent by your browser to better understand our customers. For example, we collect information regarding your IP address, referring domain names, the type of browsers used, operating system software, screen resolutions, color capabilities, browser plug-ins, language settings, cookie preferences, search engine keywords and JavaScript enablement.

Use of Information We Collect:

We use the collected information necessary for our corporate functions. This includes (i) carrying out our contractual obligations, (ii) communicating with you regarding potential business or business issues; (iii) notifying you of an issue with the Platform or a user of the Platform. By providing your personal information to us, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR 310 et seq.), as amended from time to time and other telemarketing laws or rules. Notwithstanding that your telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, we reserve the right to contact you via telemarketing in accordance with the Amended Telemarketing Sales Rule.

We do not have business associates under the age of 18 and therefore we will never knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be immediately deleted from our database.

We process personal information on our servers in many countries around the world, including the United States. We may transfer your personal information to and from the United States.

Transparency and Choice:

You may locate and disable cookies by and through your browser settings. We do not acknowledge do-not-track technology. If you disable cookies, you will not be able to use all the features and functionality of our website. To the extent you do not wish to receive commercial emails from us, you can opt out of these emails by sending your request to tobin [at] uptownleads.com.

How We Share Information:

We do not share your personal information with companies, organizations and individuals, except as follows:

  • Vendors and Service Providers. We disclose your personal information to third party service providers and vendors in order to effect or carry out any transaction that you have requested from us or as necessary to complete our contractual obligations with you. This includes service providers, accountants, counsel, lookup and reference services, data enhancement vendors, suppression and validation services.
  • Legal reasons. We will share personal information with companies, organizations or individuals outside of our company if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
    • meet any applicable law, regulation, legal process or enforceable governmental request;
    • detect, prevent, or otherwise address fraud, security or technical issues; or
    • protect against harm to the rights, reputation, property or safety of ours, our clients, our consumers or the public as required or permitted by law.
  • In connection with a merger or sale. If we enter into discussions to sell, merge or otherwise reorganize our business, we reserve the right to transfer and disclose all data (including personal and anonymous user information) to prospective and/or actual purchasers or investors. We will require that such purchasers/investors treat the transferred data as described in this Privacy Notice that exists prior to the change unless and until you consent to their Privacy Policy.

How to Access and Updating Your Personal or Corporate Information:

  • You are required to keep your personal and corporate information updated and accurate. As such, we allow you to update it quickly. We maintain this information for business and legal purposes as long as we reasonably believe it is necessary. When updating your personal information, we will ask you to verify your identity before we act on your request.
  • We reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems).
  • We can provide assistance to information access and correction upon request except where it would require a disproportionate effort. If you request to delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems to protect and secure the validity of earlier information.
  • If you are a California resident you have the right to request information regarding the manner in which we share certain categories of your personal information with third parties. You are entitled to receive a copy of this information in a standardized format and the information will not be specific to you individually. Please contact us for these requests.

Information Security:

We have industry standard security measures in place to protect against the loss, misuse, and alteration of personal information under our control. Although we take reasonable technological and personnel precautions to protect your data, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, we cannot and do not warrant that your information will be absolutely secure. Any transmission of data at or through our website is at your own risk.

Changes To Our Privacy Practices:

We reserve the right to change our Privacy Notice at any time without notice. However, these changes will not reduce your privacy on a retrospective basis. If we do reduce your privacy expectations, we will notify you of the change directly. All other changes will be post any Privacy Policy changes on this page.

California Privacy Rights
This section is provided pursuant to the California Consumer Privacy Act of 2018 (the “CCPA”) and other applicable California privacy laws. This section applies solely to our users who are California residents as defined under applicable California privacy laws.

Information We Collect
Within the last twelve (12) months, we have or may have collected the following categories of information from our users and/or consumers:

  1. identifiers, such as a name, alias, unique personal identifier, online identifier, IP address, email address, or other similar identifiers;
  2. personal information listed under Cal. Civ. Code § 1798.80(e);
  3. characteristics of protected classifications under California or federal law;

We obtain the categories of personal information listed above from the following categories of sources:

  1. directly from users, such as you, as described above under “Personal Information that You Provide to Us”;
  2. indirectly from other users of our sites and services;
  3. indirectly from third-parties that interact with us in connection with the services that we perform; and
  4. directly and indirectly through cookies and other technologies, as described above under “Other Information We Automatically Collect through Cookies and Other Technologies.”

Using and Sharing of Personal Information
The personal information described in the categories above may be used for the business purposes listed above under “How We Use Personal Information.”

We disclose your personal information for a business purpose to the following categories of third parties: (a) service providers and (b) third parties to whom you authorize or direct us to disclose your personal information in connection with our sites and services. In the preceding twelve (12) months, we have disclosed the personal information described in the categories above for the business purposes listed above under “Sharing Personal and Non-Personal Information.” We also may share personal information about you for any other purpose(s) disclosed to you at the time we collect your information or with your consent.

Personal Information “Sold” to Third Parties
We may share information that we have about you, such as a cookie ID or IP address, with third-party marketing partners who may use this information, on our behalf, to help us deliver advertising on our sites as well as on third-party websites.

In the preceding twelve (12) months, we have made available personal information included in the categories described above to third-parties, including our third-party marketing partners to deliver advertising.

We do not sell the personal information of consumers that we know are minors under 16 years of age without affirmative authorization as required under the CCPA.

Your Access and Deletion Rights under the CCPA
As of January 1, 2020, California residents, as defined under applicable California privacy laws, may take advantage of the following rights:

  1. You may request, up to two (2) times each year, that we disclose to you, once we receive and confirm your verifiable consumer request, the: (i) categories and specific pieces of personal information that we have collected about you; (ii) categories of sources from which your personal information is collected; (iii) business or commercial purpose for collecting your personal information; (iv) categories of personal information that we disclosed for a business purpose; (v) categories of personal information that we sold about you; (vi) categories of third-parties with whom we have shared your personal information; and (vii) business or commercial purpose for selling your personal information.
  2. Subject to certain exceptions and up to two (2) times each year, you may request that we delete any of your personal information that we collected from you. Once we receive and confirmed your verifiable consumer request for deletion, we will delete (and direct our service providers to delete) such personal information from our records, unless an exception applies.

Exercising Your Access and Deletion Rights under the CCPA
To exercise the access and deletion rights described above, please submit a request to us by either:

You will be asked to provide certain identifying information, such as your name, email, and residency. You will also be asked to validate your request by clicking a validation link in an email that will be sent to the email address you provided. While processing your request, we may ask you to provide further verifying documentation, such as proof of residency and identity. We will only use personal information provided in a request to verify the requestor’s identity or authority to make the request.

Your request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or that you have authority to make the request; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request through an authorized agent acting on your behalf, such authorized agent must provide proof of written authorization to do so, and you must verify your identity directly with us, unless such authorized agent provides proof of a power of attorney pursuant to Probate Code sections 4000 to 4465.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Opting-out of the Sales of your Personal Information
Subject to certain exclusions under the CCPA, you have the right to opt-out of the sale of your personal information. Once we receive your request, we will not sell your personal information, unless an exclusion applies.

We may deny your request to opt-out if we have a good-faith, reasonable, and documented belief that the request is fraudulent.

Non-Discrimination
We will not discriminate against you for exercising any of your rights under the CCPA. Accordingly, and unless permitted by the CCPA, we will not:

  1. deny you goods or services;
  2. charge you different prices or rates for goods or services, including through the use of discounts or by imposing penalties;
  3. provide you a different level or quality of goods or services; or
  4. suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

We may charge a different price or rate or provide a different level of service if the difference is reasonably related to the value provided by your personal information.

Other Applicable California Privacy Laws
Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your personal information with third parties. If you reside in California and you have provided us with your personal information, you may request information about our disclosures of certain categories of your personal information to third parties for direct marketing purposes. To make such a request, please fill out our Privacy Contact Form with “California Privacy Rights” in the subject line and allow 30 days for a response. We will not accept requests via the telephone, mail, or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

In accordance with Section 22581 of the California Business and Professions Code if you are a California resident under the age of 18, you may request and obtain the removal of content or information you have publicly posted. To make such a request, please fill out our Privacy Contact Form with “California Privacy Rights” in the subject line. Please specify the site(s) or service(s) to which your removal request relates, including any URLs where the content or information is posted, and the specific content or information you posted for which you are requesting removal. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

Nevada Privacy Rights
FOR RESIDENTS OF NEVADA ONLY. In accordance with SB 220, Nevada consumers may opt-out of the sale of their personal information to third parties. If you reside in Nevada and you have provided us with your personal information, you may choose to opt-out of the sale of such personal information by filling out our Privacy Contact Form or by emailing us at privacy@uptmedia.com with “Nevada Privacy Right” in the subject line. We may request for additional information from you in order to verify your identity and/or the authenticity of your request.

EU Privacy Rights
FOR RESIDENTS OF THE EUROPEAN UNION ONLY. Under European data protection law, in certain circumstances, you have the right to:

  1. request access to your personal information;
  2. request correction of your personal information;
  3. request erasure of your personal information;
  4. object to processing of your personal information;
  5. request restriction of processing your personal information;
  6. request transfer of your personal information; and
  7. withdraw your consent.

In addition, you have the right to ask us not to process your personal information for marketing purposes. We will usually inform you (before collecting your personal information) if we intend to use your personal information for such purposes or if we intend to disclose your information to any third party for such purposes.

If you believe that we have not complied with its obligations under this Privacy Policy or European law, you have the right to make a complaint to an EU Data Protection Authority.

SUMMARY
The Company may update this Privacy Policy from time to time. We may notify you about significant changes in the way we treat your information by sending a notice to you, although we are not required to do so.

Notwithstanding the foregoing, we reserve the right to change this Privacy Policy without any notice whatsoever to you and for whatever reason we deem appropriate under the circumstances. We encourage you to periodically check back and review this Privacy Policy so that you always will know what information we collect, how we use it, and to whom we disclose it.
